Welcome to Focal Prep. These Terms of Service (“Terms”) explain the rules for using our website, tools, practice questions, accounts, study features, and related services.

These Terms are between you and Focal Prep (“Focal Prep,” “we,” “our,” or “us”). By visiting or using focalprep.com, creating an account, using practice tools, viewing questions, accessing progress features, or using any related services, you agree to these Terms.

If you do not agree to these Terms, please do not use Focal Prep.

1. About Focal Prep

Focal Prep is an online test preparation platform that provides practice questions, study tools, progress tracking, analytics, recommendations, question review features, study-circle tools, XP/leaderboard features, and related educational resources.

Focal Prep is intended to help users practice and improve their test-taking skills. It is not a school, college, testing agency, official test administrator, or admissions service.

2. No Affiliation With College Board

Focal Prep is an independent test preparation platform.

Focal Prep is not affiliated with, endorsed by, sponsored by, or approved by College Board or any official SAT administrator.

Any references to the SAT or other standardized tests are used only to describe the type of preparation or educational content offered by Focal Prep.

3. Who May Use Focal Prep

You must be at least 13 years old to use Focal Prep.

If you are under the age of majority where you live, you may only use Focal Prep with the permission of a parent or legal guardian. By using Focal Prep, you confirm that you meet these requirements or that your parent or legal guardian has allowed you to use the Services.

We do not knowingly allow children under 13 to create accounts or submit personal information. If we learn that an account belongs to a user under 13, we may delete the account and related information.

4. Acceptance of These Terms

By using Focal Prep, you agree to follow these Terms and all applicable laws.

You agree that:

  • You will use Focal Prep only for lawful purposes.
  • You will not misuse or interfere with the Services.
  • You will provide accurate account information.
  • You will follow any rules, limits, or instructions shown on the site.
  • You understand that Focal Prep may change, update, suspend, or discontinue features over time.

If you use Focal Prep on behalf of another person or organization, you represent that you have permission to accept these Terms on their behalf.

5. Accounts

Some parts of Focal Prep may require an account.

When you create an account, you agree to provide accurate and current information. You are responsible for keeping your account information updated.

You are also responsible for:

  • Keeping your login information secure
  • Not sharing your password with others
  • All activity that happens under your account
  • Letting us know if you believe your account has been accessed without permission

We are not responsible for losses caused by your failure to keep your account secure.

We may suspend, restrict, or remove accounts that violate these Terms, create security risks, abuse the Services, or cause harm to Focal Prep or other users.

6. Educational Purpose and No Score Guarantee

Focal Prep is provided for educational and study purposes only.

We work to provide useful practice questions, explanations, analytics, recommendations, and study tools. However, we do not guarantee that using Focal Prep will result in:

  • A specific SAT score
  • A specific score increase
  • Admission to any school or college
  • A scholarship
  • A grade improvement
  • A specific academic result
  • Any other particular outcome

Your results may depend on many factors, including your study habits, prior knowledge, time spent practicing, test-day conditions, and outside preparation.

You are responsible for how you use the information and tools provided by Focal Prep.

7. Practice Questions, Explanations, and Accuracy

We try to make Focal Prep’s questions, answer choices, explanations, analytics, and recommendations accurate and helpful.

However, educational content may sometimes contain mistakes, unclear wording, formatting issues, outdated information, or technical errors. We do not guarantee that all questions, explanations, scores, analytics, recommendations, or other content will always be correct, complete, or error-free.

We may edit, remove, replace, or update content at any time, including questions, explanations, answer keys, categories, difficulty levels, analytics, or recommendations.

If you find an issue with a question or explanation, you may report it through the site or contact us.

8. Ads and Free Access

Focal Prep may offer free access to certain features supported by advertising.

By using the free version of Focal Prep, you understand that ads may appear on certain pages or areas of the Services. Ads may be provided by third-party advertising partners, such as Google AdSense.

You agree not to:

  • Artificially generate ad views, ad clicks, or impressions
  • Use bots, scripts, automated tools, or other methods to manipulate ads
  • Encourage others to click ads for the purpose of supporting Focal Prep
  • Interfere with ad delivery systems
  • Attempt to exploit or manipulate ad-related systems

Focal Prep may limit access to some free features if ads cannot be displayed, if ad systems are blocked, or if we detect abuse or technical issues.

9. Ad-Free Subscription

Focal Prep may offer an optional paid Ad-Free Subscription.

The Ad-Free Subscription is intended to remove ads from the user experience while the subscription is active. Unless we clearly state otherwise, the Ad-Free Subscription does not guarantee additional educational content, special score improvements, tutoring, or extra services beyond the removal of ads.

Subscription features, pricing, billing periods, and included benefits may change over time. Any current price and billing details will be shown before purchase.

10. Payments and Billing

If you purchase an Ad-Free Subscription or another paid feature, payment may be processed by a third-party payment provider such as Stripe.

Focal Prep does not directly store your full payment card number or payment security code. Payment processing is handled by the payment provider according to its own terms and privacy policy.

By making a purchase, you agree to provide accurate billing information and authorize the payment provider to charge your selected payment method for the amount shown at checkout.

You are responsible for any taxes, fees, or charges that may apply to your purchase.

11. Subscription Renewal and Cancellation

If the Ad-Free Subscription is offered as a recurring subscription, it may automatically renew unless you cancel before the renewal date.

You may cancel your subscription through the account settings, billing portal, or other cancellation method provided by Focal Prep or the payment provider.

Canceling a subscription prevents future renewal charges, but it may not automatically refund past payments. After cancellation, you may continue to receive ad-free access until the end of your current paid billing period, unless otherwise stated.

12. Refunds

Unless required by law or clearly stated otherwise, payments for subscriptions or paid features are generally non-refundable.

We may choose to issue refunds at our discretion in certain situations, such as duplicate charges, technical billing errors, or other special circumstances.

Refund decisions do not create an obligation to provide similar refunds in the future.

13. Acceptable Use

You agree to use Focal Prep responsibly and only for lawful purposes.

You may not:

  • Hack, attack, disrupt, overload, or damage the Services
  • Attempt to access accounts, data, systems, or areas of the site without permission
  • Use bots, scrapers, crawlers, scripts, or automated tools without permission
  • Copy, download, extract, mass-save, or redistribute large amounts of Focal Prep content
  • Reverse engineer, bypass, or interfere with site systems
  • Abuse reports, feedback forms, study-circle tools, leaderboards, XP systems, or account features
  • Upload, submit, or transmit malware, harmful code, spam, or deceptive content
  • Harass, threaten, impersonate, or target other users
  • Use Focal Prep to violate another person’s rights
  • Remove copyright notices, branding, or ownership notices
  • Attempt to bypass access limits, subscription restrictions, ad systems, security systems, or account protections
  • Use Focal Prep in a way that violates applicable law or these Terms

We may investigate suspected misuse and take action, including limiting features, removing content, suspending accounts, deleting accounts, or blocking access.

14. User-Submitted Content

Focal Prep may allow users to submit content, including feedback, question reports, support requests, study-circle content, messages, profile information, or other materials.

You are responsible for anything you submit.

You agree that you will not submit content that:

  • Is unlawful, harmful, abusive, threatening, hateful, or harassing
  • Violates another person’s privacy or intellectual property rights
  • Contains malware, spam, or deceptive material
  • Impersonates another person or misrepresents your identity
  • Interferes with the operation or safety of the Services

We may review, remove, restrict, or delete user-submitted content if we believe it violates these Terms or creates risk for Focal Prep, users, or third parties.

15. Permission to Use User-Submitted Content

You keep ownership of content you submit to Focal Prep.

However, by submitting content, you give Focal Prep permission to use, store, display, reproduce, modify, and process that content as needed to:

  • Operate the Services
  • Provide account features
  • Respond to support requests
  • Review question reports
  • Improve questions, explanations, and site features
  • Protect the Services
  • Enforce these Terms
  • Comply with legal obligations

This permission is worldwide, non-exclusive, royalty-free, and lasts as long as needed for the purposes described above.

16. Feedback and Suggestions

If you send us feedback, ideas, suggestions, bug reports, feature requests, or improvement ideas, you allow us to use them without restriction or compensation to you.

This means we may use your feedback to improve Focal Prep, create new features, fix issues, or change the Services.

You are not required to send feedback, and sending feedback does not give you ownership of any changes we make based on it.

17. Focal Prep Content and Intellectual Property

Focal Prep owns or has rights to the website, design, branding, logos, software, code, layouts, graphics, questions, explanations, analytics systems, study tools, and other content provided through the Services.

These materials are protected by copyright, trademark, and other laws.

You are allowed to use Focal Prep for personal, non-commercial study purposes, subject to these Terms.

You may not copy, reproduce, publish, sell, license, distribute, modify, publicly display, create derivative works from, or commercially exploit Focal Prep content unless we give you written permission.

18. Limited License to Use the Services

As long as you follow these Terms, Focal Prep gives you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for personal study and educational purposes.

This license does not give you ownership of Focal Prep, its content, its software, or any related intellectual property.

We may revoke this license if you violate these Terms.

Focal Prep may use or link to third-party services, including but not limited to:

  • Hosting providers
  • Cloud and security services
  • Analytics tools
  • Advertising networks
  • Payment processors
  • Email or support tools
  • External websites or resources

Third-party services are controlled by their own terms and privacy policies. We are not responsible for third-party websites, services, content, policies, security, or practices.

Your use of third-party services may be subject to additional terms from those providers.

20. Privacy

Your use of Focal Prep is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect personal information.

21. Availability and Changes to the Services

We may change, update, add, remove, pause, or discontinue any part of Focal Prep at any time.

This includes changes to:

  • Practice tools
  • Question banks
  • Explanations
  • Analytics
  • Recommendations
  • Study-circle features
  • Boss fight or game-style features
  • XP, levels, and leaderboards
  • Free features
  • Paid features
  • Ad placements
  • Account features
  • Site design or navigation

We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.

We may perform maintenance, updates, or emergency fixes that temporarily affect access to the Services.

22. Account Suspension or Termination

We may suspend, restrict, or terminate your account or access to Focal Prep if we believe:

  • You violated these Terms
  • Your account creates security risk
  • Your activity may harm Focal Prep, users, third parties, or the Services
  • You attempted to misuse or interfere with the Services
  • We are required to do so by law
  • Continuing to provide access would create legal, technical, or safety concerns

We may also remove or restrict content connected to your account.

You may stop using Focal Prep at any time. You may request deletion of your account or personal information by using the privacy request process described in our Privacy Policy.

23. Disclaimers

Focal Prep is provided on an “as is” and “as available” basis.

To the fullest extent allowed by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, reliability, security, and non-infringement.

We do not guarantee that:

  • The Services will always work without interruptions
  • The Services will always be secure or error-free
  • All questions, explanations, analytics, or recommendations will be correct
  • Your account data will never be lost
  • The Services will meet your expectations
  • Any specific score, result, or outcome will occur

You use Focal Prep at your own risk.

24. Limitation of Liability

To the fullest extent allowed by law, Focal Prep and its owners, operators, team members, partners, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

This includes damages related to:

  • Lost data
  • Lost profits
  • Lost opportunities
  • Service interruptions
  • Account issues
  • Errors in questions or explanations
  • Score outcomes
  • Admissions outcomes
  • Reliance on study recommendations
  • Unauthorized access
  • Third-party services
  • Technical problems
  • Use or inability to use Focal Prep

To the fullest extent allowed by law, our total liability for any claim related to the Services will not exceed the amount you paid to Focal Prep in the three months before the event giving rise to the claim, or $25 if you have not paid Focal Prep during that period.

Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.

25. Indemnification

You agree to defend, indemnify, and hold harmless Focal Prep, its owners, operators, team members, service providers, partners, and affiliates from claims, damages, losses, liabilities, costs, or expenses, including reasonable legal fees, arising from:

  • Your use of Focal Prep
  • Your violation of these Terms
  • Your violation of another person’s rights
  • Content you submit
  • Misuse of your account
  • Your violation of applicable law

We may choose to control the defense of any claim that requires indemnification, and you agree to cooperate with us.

26. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles.

If a dispute is brought in court, you agree that it may be handled in the state or federal courts located in Georgia, unless applicable law requires a different location.

27. Resolving Issues

Before bringing a formal claim, you agree to first contact us and try to resolve the issue informally.

28. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the “Last updated” date at the top of this page. If the changes are important, we may also provide notice through the website, your account, or email.

Your continued use of Focal Prep after updated Terms are posted means you accept the updated Terms.

If you do not agree to the updated Terms, you should stop using Focal Prep.

29. Severability

If any part of these Terms is found to be invalid, illegal, or unenforceable, the rest of the Terms will remain in effect.

The invalid or unenforceable part will be interpreted or modified to the extent needed to make it enforceable while keeping the original purpose as much as possible.

30. No Waiver

If we do not enforce part of these Terms right away, that does not mean we waive our right to enforce it later.

Any waiver must be in writing to be effective.

31. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms shown for specific features, make up the entire agreement between you and Focal Prep regarding your use of the Services.

They replace any prior agreements or understandings about the Services.
